TERMS AND CONDITIONS OF SALE
The owner of the online store Zanneto OÜ (hereinafter referred to as the “Online Store”) is www.curlystories.com (registry code 16025060), located at Teeääre, Laane küla, 61703 Kambja vald, Tartu maakond.
1. Validity of the Sales Contract, Product and Price Information
1.1. These Terms and Conditions of Sale apply to purchases of goods from the Online Store.
1.2. The prices of the products sold in the Online Store are indicated next to the products. A delivery fee is added to the price where applicable.
1.3. The delivery fee depends on the purchaser’s location and the selected delivery method. The delivery fee is displayed to the purchaser during the checkout process.
1.4. All prices displayed in the Online Store are in Euros (€).
1.5. Product information is provided immediately adjacent to the product in the Online Store.
2. Placing an Order
2.1. To order products, the purchaser must add the desired products to the shopping cart.
2.2. To complete the order, the purchaser must fill in all required fields and select a suitable delivery method.
2.3. The total amount payable is then displayed on the screen and may be paid securely using the payment methods provided by Montonio Finance OÜ.
2.4. Available payment methods may include:
* Estonian bank payments: Swedbank, LHV, SEB, Coop, Laminar, Citadele, Artea, Revolut, Indexo, N26;
* Latvian bank payments: Swedbank, LHV, SEB, Coop, Laminar, Citadele, Artea, Revolut, Indexo, N26;
* Lithuanian bank payments: Swedbank, LHV, SEB, Coop, Laminar, Citadele, Artea, Revolut, Indexo, N26;
* Buy now, pay later services: InBank;
* Finnish bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästöpankki, OP, POP Pankki, S-Pankki, Säästopankki;
* Card payments: Visa / MasterCard;
* Gift cards: Kniks Gift Card.
2.5. When using a bank-link payment method, the purchaser must click the “Return to Merchant” button after completing the payment.
2.6. The personal data necessary for processing payments is transferred to the authorized processor Montonio Finance OÜ.
2.7. The sales contract enters into force upon receipt of the amount payable into the Online Store’s bank account.
2.8. If the Online Store is unable to deliver the ordered goods due to stock unavailability or any other reason, the purchaser shall be informed as soon as possible and any payments received, including delivery costs, shall be refunded without undue delay, but no later than within fourteen (14) days from notification.
3. Shipment
3.1. Goods are shipped to the following countries: Estonia, Latvia, Lithuania.
3.2. Available delivery methods are: DPD.
3.3. The purchaser bears the shipping costs. The corresponding shipping fee is displayed alongside the selected delivery method.
3.4. Deliveries within Estonia, Latvia, Lithuania generally arrive at the destination specified by the purchaser within 10 business days from the entry into force of the sales contract.
3.5. International deliveries generally arrive within 45 calendar days.
3.6. In exceptional circumstances, the Online Store reserves the right to deliver goods within up to forty-five (45) calendar days.
4. Right of Withdrawal
4.1. After receiving the order, the purchaser has the right to withdraw from the contract concluded with the Online Store within fourteen (14) days.
4.2. Depending on the nature of the product or service, the right of withdrawal may not apply. Any such exceptions shall comply with applicable legislation and be clearly identified.
4.3. The right of withdrawal does not apply to legal persons.
4.4. To exercise the right of withdrawal, the purchaser may only use the goods in a manner necessary to ascertain their nature, characteristics and functioning, as would be permitted in a physical retail store.
4.5. If the goods have been used beyond what is necessary to establish their nature, characteristics and functioning, or show signs of use or wear, the Online Store may reduce the refund amount in proportion to the decrease in value of the goods.
4.6. To return the goods, the purchaser must submit a withdrawal statement to info@curlystories.com within fourteen (14) days from receipt of the goods.
4.7. Unless otherwise stated, the purchaser bears the direct costs of returning the goods.
4.8. The purchaser must return the goods within fourteen (14) days of submitting the withdrawal statement or provide evidence that the goods have been handed over to the carrier within that period.
4.9. Upon receipt of the returned goods, the Online Store shall refund all payments received from the purchaser under the contract without undue delay and no later than fourteen (14) days thereafter.
4.10. The Online Store may withhold the refund until the returned goods have been received or until the purchaser has provided proof of return, whichever occurs first.
4.11. If the purchaser expressly chose a delivery method other than the least expensive standard delivery option offered by the Online Store, the Online Store is not required to reimburse the additional delivery costs.
4.12. The Online Store reserves the right to withdraw from the sales transaction and require the return of the goods if the listed price was significantly below the market price due to an obvious error.
5. Defective Goods
5.1. The Online Store is liable for any non-conformity of goods sold to the purchaser that existed at the time of delivery and becomes apparent within two (2) years from delivery.
5.2. During the first year following delivery, it is presumed that the defect existed at the time of delivery unless the Online Store proves otherwise.
5.3. The purchaser has the right to submit a complaint within two (2) months of discovering a defect by contacting the Online Store at info@curlystories.com.
5.4. The Online Store is not liable for defects that have arisen after delivery of the goods to the purchaser.
5.5. If the goods purchased from the Online Store are defective and the Online Store is responsible for the defect, the Online Store shall repair or replace the defective goods.
5.6. If repair or replacement is not possible, the Online Store shall refund all payments made under the sales contract.
5.7. The Online Store shall respond to consumer complaints in writing or in a form that can be reproduced in writing within fifteen (15) days.
6. Direct Marketing and Processing of Personal Data
6.1. The Online Store processes personal data solely for the purpose of fulfilling orders and delivering goods.
6.2. Personal data may be transferred to transport service providers where necessary for delivery.
6.3. The Online Store sends newsletters and promotional offers only where the purchaser has expressly consented to receive such communications.
6.4. The purchaser may unsubscribe from marketing communications at any time by following the instructions included in the communication or by contacting the Online Store.
7. Dispute Resolution
7.1. Any complaints concerning the Online Store must be submitted by e-mail to info@curlystories.com.
7.2. If a dispute cannot be resolved through negotiations, the purchaser may refer the matter to the Consumer Disputes Committee.
7.3. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between purchasers and the Online Store.
7.4. Proceedings before the Consumer Disputes Committee are free of charge for the purchaser.
7.5. The purchaser may also use the European Union’s consumer dispute resolution mechanisms where applicable.
8. Force Majeure
8.1. The Online Store shall not be liable for any delay in performing its obligations or for non-performance of its obligations where such delay or non-performance is caused by circumstances beyond its reasonable control (force majeure).
8.2. Force majeure events include, but are not limited to, natural disasters, pandemics, epidemics, government restrictions, interruptions in telecommunications services, cyberattacks, power outages, transportation disruptions, or other extraordinary events beyond the reasonable control of the Online Store.
8.3. In the event of force majeure, the Online Store shall perform its obligations as soon as reasonably possible after the circumstances have ceased.
9. Intellectual Property Rights
9.1. All content published on the Online Store, including but not limited to texts, images, graphics, logos, trademarks, product descriptions, software, design elements and other materials, is protected by intellectual property laws.
9.2. No content of the Online Store may be copied, reproduced, distributed, modified, published or otherwise used without the prior written consent of the Online Store, except where permitted by applicable law.
9.3. The purchase of goods from the Online Store does not transfer any intellectual property rights to the purchaser.
10. Limitation of Liability
10.1. The Online Store shall be liable only for direct damages caused by intentional misconduct or gross negligence, except where mandatory consumer protection legislation provides otherwise.
10.2. Nothing in these Terms shall exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
10.3. The Online Store shall not be liable for damages resulting from improper use of the goods, failure to follow instructions, normal wear and tear, or circumstances beyond the Online Store’s control.
11. Data Protection
11.1. The Online Store processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR), the Estonian Personal Data Protection Act and other applicable legislation.
11.2. Detailed information regarding the collection, processing, storage and protection of personal data is provided in the Privacy Policy available on the Online Store’s website.
11.3. By placing an order, the purchaser confirms that they have read the Privacy Policy.
12. Digital Services and Website Availability
12.1. The Online Store makes reasonable efforts to ensure continuous availability of its website but does not guarantee uninterrupted access at all times.
12.2. Temporary interruptions may occur due to maintenance, technical issues, security updates or circumstances beyond the Online Store’s control.
12.3. The Online Store reserves the right to modify, suspend or discontinue any part of the website where necessary.
13. Governing Law and Jurisdiction
13.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Estonia.
13.2. Nothing in these Terms shall deprive consumers of mandatory rights granted under the consumer protection laws applicable in their country of residence within the European Union.
13.3. Any disputes not resolved through negotiation or alternative dispute resolution procedures shall be subject to the competent courts of the Republic of Estonia unless mandatory consumer protection legislation provides otherwise.
14. Consumer Dispute Resolution
14.1. If the purchaser has a complaint regarding the Online Store, the purchaser should first contact the Online Store directly.
14.2. If the dispute cannot be resolved by agreement, the purchaser may submit a complaint to the Consumer Disputes Committee operating under the Estonian Consumer Protection and Technical Regulatory Authority (TTJA).
14.3. Proceedings before the Consumer Disputes Committee are free of charge for consumers.
14.4. Information regarding dispute resolution procedures is available on the website of the Consumer Protection and Technical Regulatory Authority.
15. Amendments to the Terms and Conditions
15.1. The Online Store reserves the right to amend these Terms and Conditions at any time to comply with applicable legislation, business requirements or operational changes.
15.2. The version of the Terms and Conditions applicable to the purchaser shall be the version in force at the time the order is placed.
16. Final Provisions
16.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.2. Failure by the Online Store to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.3. These Terms and Conditions constitute the entire agreement between the purchaser and the Online Store concerning purchases made through the Online Store.
16.4. These Terms and Conditions enter into force on the date of publication on the Online Store’s website.
